These Website Terms of Use and Agreement (“Terms”) govern your access to and use of the website located at cmamedicine.com, including its pages, content, forms, scheduling links, virtual consultation features, communications, and related online services collectively referred to as the “Site.”

The Site is operated by CMA Medicine, also known as the Center for Modern Aesthetic Medicine (“CMA,” “we,” “us,” or “our”).

By accessing, browsing, submitting information through, or otherwise using the Site, you acknowledge that you have read, understood, and agree to these Terms and our Website Privacy Policy. If you do not agree, please do not use the Site.

1. About CMA Medicine

CMA Medicine is a physician-led medical and aesthetic practice offering services that may include aesthetic dermatology, laser and energy-based treatments, skin rejuvenation, injectables, body treatments, women’s and men’s health services, medical weight-management services, wellness services, and other medical or cosmetic treatments.

Treatment recommendations and eligibility are determined individually following an appropriate consultation, examination, medical-history review, and informed-consent process.

2. Website Information Is Not Medical Advice

The Site is provided for general informational, educational, marketing, and scheduling purposes.

Information presented on the Site:

• Is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
• Is not a substitute for an examination, diagnosis, or treatment recommendation from a qualified healthcare professional.
• Should not be relied upon to make decisions about medications, procedures, medical devices, or treatment.
• May not apply to your individual medical condition, skin type, medical history, medications, allergies, or treatment goals.

Always seek the advice of a qualified healthcare professional regarding a medical condition or treatment decision. Never disregard professional medical advice or delay seeking care because of information presented on the Site.

3. Medical Emergencies

The Site, website forms, email addresses, social-media accounts, text-messaging services, and online appointment tools are not intended for emergencies.

If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately.

Do not use the Site to report an emergency, urgent adverse reaction, rapidly worsening symptoms, or another time-sensitive medical concern.

4. No Doctor-Patient Relationship Through Website Use

Accessing the Site, reading its content, submitting a contact form, sending an email, requesting an appointment, or participating in a preliminary virtual inquiry does not, by itself, create a doctor-patient relationship between you and CMA or any CMA physician, clinician, employee, or contractor.

A professional relationship is established only after CMA has accepted you as a patient and the appropriate evaluation, documentation, consent, and clinical requirements have been completed.

CMA is not obligated to accept any person as a patient or provide any requested treatment.

5. Eligibility and Minors

You must be at least 18 years old to independently submit personal information, schedule services, make purchases, or enter into agreements through the Site.

A parent or legal guardian must act on behalf of a minor where permitted by law. Certain treatments may not be available to minors, even with parental consent.

By using the Site, you represent that you have the legal authority to enter into these Terms or are acting with the authorization of a parent, guardian, or authorized personal representative.

6. Appointments and Consultations

Appointment requests are subject to availability, clinical appropriateness, provider availability, verification, and confirmation by CMA.

Submitting an online appointment request does not guarantee that an appointment has been scheduled. An appointment is confirmed only after you receive confirmation from CMA or its authorized scheduling provider.

You agree to provide complete and accurate contact, health, insurance, payment, and scheduling information. You are responsible for promptly updating information that changes.

Virtual consultations may be subject to additional requirements, including identity and location verification, provider-licensure limitations, technology requirements, clinical eligibility, and separate telehealth or consultation consent forms.

7. Cancellation and No-Show Policy

Unless CMA provides a different policy at the time of scheduling, CMA’s currently published appointment policy requires at least 24 hours’ notice when canceling or rescheduling an appointment.

CMA may maintain a payment card on file for appointment-related charges. Under the currently published policy:

• A cancellation made fewer than 24 hours before the appointment may result in a $75 cancellation fee.
• Failure to attend a scheduled appointment may result in a $100 no-show fee.

Certain appointments, procedures, events, memberships, packages, consultations, or reserved treatment times may be subject to different deposits, cancellation periods, forfeiture terms, or fees. The specific terms disclosed when you schedule or purchase will control if they differ from this general policy.

CMA may modify its scheduling and cancellation policies by posting an updated policy or providing notice during booking.

8. Treatment Eligibility, Risks, and Results

Medical and aesthetic treatments involve individual considerations, limitations, risks, potential complications, recovery requirements, contraindications, and possible side effects.

Information about benefits, treatment duration, downtime, expected outcomes, or the number of recommended sessions represents general information only. Results vary based on factors that may include:

• Age and general health.
• Skin type, skin condition, anatomy, and treatment area.
• Medical history, medications, allergies, and prior procedures.
• Lifestyle, sun exposure, adherence to instructions, and healing response.
• The treatment selected and the number of sessions completed.

CMA does not guarantee that any treatment will produce a specific result or that your result will match a photograph, testimonial, illustration, rendering, simulation, or result experienced by another patient.

Your provider will discuss material risks, benefits, alternatives, and expected outcomes through a separate informed-consent process before treatment.

9. Before-and-After Images and Testimonials

Before-and-after photographs, patient stories, reviews, and testimonials are provided as examples of individual experiences. They do not represent or guarantee the result that another patient will achieve.

Photographs may be affected by lighting, positioning, camera settings, makeup, healing stage, treatment timing, or other variables. CMA will use identifiable patient photographs for public-facing purposes only when appropriate authorization has been obtained.

Testimonials reflect the views and experiences of the individuals providing them and may not represent the experience of every patient.

10. Medical Products and Medication Information

References to prescription medications, compounded medications, injectable products, hormones, supplements, skincare products, medical devices, or treatments are for general informational purposes.

Availability, approval status, labeling, indications, contraindications, risks, and prescribing requirements may change. Certain treatments may involve an off-label use that a qualified provider may discuss with you when legally and clinically appropriate.

Nothing on the Site constitutes a prescription, medication order, diagnosis, or individualized recommendation.

11. Pricing, Payments, Insurance, and Financing

Prices, promotions, packages, and treatment estimates shown on the Site are subject to change and may not include all fees associated with an individualized treatment plan.

A consultation may be required before a final treatment price can be provided. You are responsible for reviewing and accepting applicable pricing, payment, deposit, refund, financing, and cancellation terms before purchasing or receiving services.

Many aesthetic and cosmetic services are not covered by health insurance. You are responsible for confirming coverage with your insurer and for paying charges not paid by insurance.

Payment plans, patient financing, gift-card processing, product purchases, and other financial services may be provided by independent third parties. CMA does not control their approval decisions, interest rates, fees, security practices, or contractual terms.

12. Memberships, Packages, Promotions, and Gift Cards

CMA memberships, treatment packages, banked treatment credits, promotional offers, gift cards, loyalty programs, raffles, and special events may be governed by separate terms presented during enrollment or purchase.

These separate terms may address:

• Minimum commitments.
• Recurring payments.
• Cancellation or early-termination fees.
• Expiration or forfeiture.
• Transferability.
• Eligible treatments.
• Combining discounts or promotions.
• Refunds and unused balances.

When separate terms apply, those terms are incorporated into this Agreement and control with respect to the applicable membership, purchase, or promotion.

Promotions are subject to availability and may be modified or discontinued as permitted by law.

13. Online Purchases and Third-Party Retailers

The Site may link to Shopify stores, skincare brands, supplement companies, financing services, appointment providers, and other independent websites.

Purchases completed on an external website are transactions between you and the applicable third party unless expressly stated otherwise. Third-party purchases are governed by that provider’s terms, return policies, privacy policies, shipping practices, and warranties.

CMA is not responsible for a third party’s website, products, services, fulfillment, data practices, or performance.

14. Electronic Communications

By contacting CMA electronically, you consent to receive communications relating to your inquiry, appointment, purchase, account, treatment, or relationship with CMA through methods you provide, which may include email, telephone, voicemail, secure portal messages, or text messages.

Electronic communications may not always be secure. Do not send highly sensitive medical, financial, or identification information through ordinary email or a general website form unless CMA directs you to do so through an approved method.

You are responsible for maintaining accurate contact information and securing your devices, email account, telephone, and passwords.

15. Text-Message Terms

When you separately provide your mobile number and consent to receive text messages, you authorize CMA and its authorized service providers to send messages to that number.

Messages may include appointment confirmations, reminders, scheduling communications, treatment instructions, account information, patient-service messages, and, where you separately consent, promotional communications.

Consent to receive marketing text messages is not a condition of receiving treatment or making a purchase. Message frequency may vary. Message and data rates may apply.

You may opt out of nonessential text messages by replying STOP. You may request assistance by replying HELP or contacting CMA directly.

Opting out of marketing messages will not prevent CMA from sending communications that are legally permitted or necessary to address an existing appointment, requested service, transaction, or patient-care matter, subject to applicable law and your communication preferences.

Mobile carriers are not responsible for delayed or undelivered messages.

16. Privacy and Health Information

CMA’s collection and use of personal information through the Site are described in the Website Privacy Policy.

Protected Health Information created or received by CMA in its capacity as a healthcare provider is governed by CMA’s HIPAA Notice of Privacy Practices and applicable federal and Florida law.

The Website Privacy Policy is not a replacement for the HIPAA Notice of Privacy Practices. If the Website Privacy Policy and Notice of Privacy Practices address the same Protected Health Information differently, the Notice of Privacy Practices and applicable law will control.

17. Acceptable Use

You agree not to:

• Use the Site for an unlawful, fraudulent, threatening, abusive, or harmful purpose.
• Impersonate another person or misrepresent your identity or authority.
• Submit false, misleading, defamatory, or unlawful information.
• Attempt to gain unauthorized access to the Site, patient systems, servers, databases, or user accounts.
• Introduce viruses, malware, malicious code, automated scraping tools, or disruptive technologies.
• Interfere with the Site’s performance, availability, or security.
• Copy, reproduce, distribute, sell, or commercially exploit Site content without written authorization.
• Use Site content to train, develop, or populate a competing commercial service without written permission.
• Violate the intellectual-property, privacy, publicity, or other rights of CMA or another person.

CMA may restrict or terminate access when it reasonably believes these Terms have been violated.

18. Intellectual Property

The Site and its contents—including text, articles, treatment descriptions, graphics, photographs, videos, designs, logos, trademarks, icons, layouts, software, and other materials—are owned by CMA or used with permission and are protected by intellectual-property laws.

CMA grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Site for personal, noncommercial purposes.

No ownership rights are transferred to you. You may not reproduce, modify, publish, distribute, publicly display, license, sell, or create derivative works from Site content without prior written authorization.

Product names and third-party trademarks belong to their respective owners.

19. User Submissions

When you submit a nonconfidential review, testimonial, comment, photograph, or other content for public use, you represent that:

• You own the content or have permission to submit it.
• The content is accurate to the best of your knowledge.
• Its use will not violate another person’s rights.
• You have obtained any necessary permissions from individuals shown or identified.

Public use of identifiable patient information or treatment photographs remains subject to applicable authorization and privacy requirements.

Do not submit another person’s confidential medical information through the Site without lawful authority.

20. Third-Party Websites and Services

Links to third-party websites are offered for convenience and do not constitute an endorsement or guarantee.

CMA does not control and is not responsible for third-party content, accessibility, availability, cybersecurity, privacy practices, terms, products, or services. You access third-party services at your own risk and should review their legal policies before providing information.

21. Website Availability and Accuracy

CMA endeavors to provide useful and accurate information but does not warrant that all Site content will always be complete, current, error-free, or available.

Medical knowledge, product labeling, treatment protocols, provider availability, prices, promotions, and technology may change. CMA may modify, suspend, remove, or discontinue any part of the Site without notice.

The Site may occasionally be unavailable because of maintenance, outages, security concerns, third-party failures, or circumstances outside CMA’s control.

22. Disclaimer of Website Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis.

CMA disclaims warranties relating to the Site, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, uninterrupted operation, and freedom from harmful code.

This website disclaimer applies to the Site and online content. It does not eliminate professional duties or patient rights relating to medical care that cannot lawfully be limited or waived.

23. Limitation of Liability

To the fullest extent permitted by law, CMA and its owners, physicians, clinicians, employees, contractors, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising solely from your access to, inability to access, or misuse of the Site or third-party links.

These limitations do not apply where prohibited by law and are not intended to waive or restrict rights or remedies relating to professional healthcare services, medical negligence, informed consent, privacy rights, or other obligations that cannot legally be disclaimed.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold CMA harmless from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Site, infringement of another person’s rights, submission of unauthorized content, or material violation of these Terms.

This provision does not apply to claims resulting from CMA’s own professional services, negligence, willful misconduct, or violation of law.

25. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, legal proceedings concerning only the use of the Site will be brought in a court of competent jurisdiction located in Duval County, Florida.

Nothing in these Terms prevents either party from seeking emergency or injunctive relief where legally appropriate.

26. Changes to These Terms

CMA may revise these Terms from time to time. The updated version will be posted on the Site with a revised “Last Updated” date.

Changes apply prospectively when posted unless another date is stated or applicable law requires additional notice or consent.

Your continued use of the Site after an update constitutes acceptance of the revised Terms.

27. Severability and Waiver

If a provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect, and the affected provision will be interpreted as closely as legally possible to its intended purpose.

A failure by CMA to enforce a provision is not a waiver of its right to enforce that provision later.

28. Entire Website Agreement

These Terms and the Website Privacy Policy constitute the agreement between you and CMA regarding use of the Site.

They do not replace separate patient, clinical, informed-consent, membership, payment, financing, photography, telehealth, prescription, or treatment agreements.
